TERMS AND CONDITIONS OF SALE

1. COMPANY INFORMATION

1.1. These Terms and Conditions (“Terms”) govern the use of the website www.timelessbdpst.com (the “Website”) and all contracts concluded between Timeless Watches Kft. and its customers through the Website.

1.3. By placing an order through the Website, the customer acknowledges and accepts these Terms.

2. DEFINITIONS

For the purposes of these Terms:

2.1. “Company”, “Seller”, “Timeless Watches”, or “Timeless Watches Kft.” means Timeless Watches Kft.

2.2. “Customer” means any person purchasing or attempting to purchase products through the Website.

2.3. “Consumer” means a natural person acting outside the scope of trade, business, craft or profession.

2.4. “Business Customer” means any person acting within the scope of trade, business, craft or profession.

2.5. “Product” means any watch, accessory, watch part, watch box or other item offered for sale by Timeless Watches Kft.

2.6. “Order” means a purchase request submitted through the Website.

2.7. “Contract” means the legally binding agreement concluded between Timeless Watches Kft. and the Customer.

2.8. “Website” means www.timelessbdpst.com and all related webpages.

3. SCOPE OF APPLICATION

3.1. These Terms apply to all sales made through the Website.

3.2. These Terms apply to both Consumers and Business Customers unless expressly stated otherwise.

3.4. In the event of inconsistency between these Terms and any incorporated policy, mandatory provisions of applicable law shall prevail.

4. PRODUCT INFORMATION

4.1. Timeless Watches Kft. primarily offers pre-owned watches.

4.2. Certain Products may be vintage, discontinued or collectible items.

4.3. Product descriptions, photographs and specifications are prepared in good faith and based upon information reasonably available at the time of listing.

4.4. Product photographs form an integral part of the Product description.

4.5. Customers are encouraged to carefully review all photographs and descriptions prior to purchase.

4.6. Minor variations in color, appearance or finish resulting from photography, lighting conditions or display settings shall not constitute defects.

4.7. Detailed provisions regarding condition, originality, authenticity and vintage products are contained in the Watch Condition & Authenticity Policy.

5. PRODUCT AVAILABILITY AND MULTI-CHANNEL SALES

5.1. Most Products offered by Timeless Watches Kft. are unique pre-owned items.

5.2. Products may be simultaneously offered through multiple sales channels, including but not limited to:

the Website;
Chrono24;
eBay;
direct sales;
trade fairs;
other sales platforms.

5.3. Product listings do not constitute legally binding offers but invitations for Customers to submit purchase offers.

5.4. Due to synchronization delays, administrative errors or simultaneous sales, a Product may become unavailable after an Order has been submitted.

5.5. If a Product becomes unavailable prior to acceptance of an Order, Timeless Watches Kft. may cancel the Order and refund any amounts already paid.

5.6. In such circumstances, the Customer’s sole remedy shall be reimbursement of amounts actually paid to Timeless Watches Kft.

6. ORDERING PROCESS

6.1. Submission of an Order constitutes an offer by the Customer to purchase the Product.

6.2. An automated order confirmation does not constitute acceptance of the Order.

6.3. A Contract is formed only when Timeless Watches Kft. expressly confirms acceptance of the Order.

6.4. Timeless Watches Kft. reserves the right to refuse Orders prior to acceptance.

6.5. Timeless Watches Kft. may refuse Orders for reasons including but not limited to:

Product unavailability;
pricing errors;
suspected fraud;
export restrictions;
sanctions compliance;
payment concerns;
legal obligations.

7. PRICES AND CURRENCY

7.1. Prices may be displayed in EUR and HUF.

7.2. Unless otherwise stated, displayed prices represent the purchase price of the Product.

7.3. Certain Products may be sold under the Hungarian margin scheme applicable to used goods.

7.4. Timeless Watches Kft. reserves the right to correct obvious pricing errors.

7.5. If a pricing error is identified after an Order has been submitted but before acceptance, Timeless Watches Kft. may reject the Order and refund any amounts already paid.

8. PAYMENT

8.1. Accepted payment methods may include:

Bank transfer;
Stripe card payments;
Wise transfers;
payment arrangements agreed in writing.

8.2. Timeless Watches Kft. reserves the right to limit available payment methods for specific transactions.

8.3. Payment must be received in full before shipment unless otherwise agreed in writing.

8.4. Timeless Watches Kft. may require additional verification for high-value transactions.

9. PRODUCT RESERVATIONS

9.1. Due to the unique nature of many Products offered by Timeless Watches Kft., Products are not automatically reserved upon submission of an Order.

9.2. A Product shall only be considered reserved where Timeless Watches Kft. expressly confirms such reservation in writing.

9.3. Unless otherwise agreed, Products remain available for purchase by other customers until full payment has been received.

10. RETENTION OF TITLE

10.1. Ownership of Products shall remain with Timeless Watches Kft. until all amounts owed in connection with the transaction have been paid in full.

10.2. Risk shall pass in accordance with applicable law and the Shipping & Customs Policy.

11. SHIPPING AND DELIVERY

11.1. Timeless Watches Kft. may offer delivery worldwide.

11.2. Shipments may be performed using FedEx, UPS, DHL or other professional logistics providers.

11.3. Delivery times are estimates only and are not guaranteed.

11.4. Timeless Watches Kft. shall not be liable for delays arising from customs procedures, carrier operations, governmental actions or force majeure events.

11.5. Detailed provisions relating to shipping, customs, duties and taxes are contained in the Shipping & Customs Policy.

12. PERSONAL COLLECTION

12.1. Personal collection may be available by prior appointment.

12.2. Timeless Watches Kft. may require identification prior to releasing Products to the Customer.

12.3. Additional arrangements relating to collection may be communicated on a case-by-case basis.

13. RIGHT OF WITHDRAWAL

13.1. Consumers may be entitled to a statutory right of withdrawal in accordance with applicable consumer protection legislation.

13.2. Business Customers are not entitled to statutory consumer withdrawal rights.

13.3. Detailed provisions governing withdrawal rights, return procedures, inspection rights and refunds are set out in the Withdrawal Policy.

13.4. Customers exercising withdrawal rights must comply with the procedures set forth in the Withdrawal Policy.

14. WARRANTY

14.1. Timeless Watches Kft. provides a twelve (12) month international warranty from the date of delivery.

14.2. The warranty applies worldwide.

14.3. The warranty covers:

authenticity of the Product; and
proper mechanical functioning of the movement.

14.4. The scope, exclusions, procedures and remedies applicable to warranty claims are governed by the International Warranty Policy.

14.5. Nothing in this section limits any mandatory statutory rights applicable under law.

15. WATCH CONDITION AND AUTHENTICITY

15.1. All Products are offered for sale in good faith as authentic.

15.2. Detailed provisions concerning:

authenticity;
originality;
vintage watches;
service history;
water resistance;
timekeeping performance;
aftermarket components;
condition disclosures;

are contained in the Watch Condition & Authenticity Policy.

15.3. Customers acknowledge that pre-owned and vintage watches may differ materially from newly manufactured products.

15.4. Product descriptions should be read together with photographs and accompanying documentation.

16. FRAUD PREVENTION AND TRANSACTION VERIFICATION

16.1. Timeless Watches Kft. reserves the right to implement commercially reasonable fraud prevention measures.

16.2. Timeless Watches Kft. may request:

proof of identity;
proof of address;
payment verification;
billing verification;
additional documentation reasonably required to verify a transaction.

16.3. Timeless Watches Kft. may suspend, delay or cancel an Order pending satisfactory verification.

16.4. Failure to provide requested verification information may result in cancellation of the Order.

16.5. Timeless Watches Kft. reserves the right to refuse transactions where fraud is suspected.

17. ANTI-MONEY LAUNDERING, SANCTIONS AND EXPORT CONTROLS

17.1. Timeless Watches Kft. is committed to complying with applicable laws relating to:

anti-money laundering;
sanctions;
export controls;
trade restrictions;
fraud prevention.

17.2. Timeless Watches Kft. reserves the right to refuse, suspend or cancel transactions where necessary to comply with legal obligations.

17.3. Timeless Watches Kft. may refuse shipment to countries, territories, persons or entities subject to legal restrictions.

17.4. Timeless Watches Kft. shall not be liable for losses arising from compliance with legal obligations, sanctions requirements or export control regulations.

18. FORCE MAJEURE

18.1. Timeless Watches Kft. shall not be liable for failure or delay in performing obligations caused by circumstances beyond its reasonable control.

18.2. Such circumstances may include:

war;
armed conflict;
terrorism;
sanctions;
governmental restrictions;
customs embargoes;
cyber incidents;
power outages;
transportation disruptions;
carrier failures;
strikes;
labor disputes;
natural disasters;
epidemics;
pandemics;
acts of God.

18.3. During the existence of a force majeure event, performance obligations may be suspended for the duration of the event.

19. LIMITATION OF LIABILITY

19.1. Nothing in these Terms excludes liability that cannot legally be excluded.

19.2. Except in cases of fraud, wilful misconduct, gross negligence, death or personal injury, Timeless Watches Kft.’s total liability arising from a transaction shall not exceed the purchase price paid for the Product giving rise to the claim.

19.3. Timeless Watches Kft. shall not be liable for:

indirect losses;
consequential losses;
loss of profit;
loss of business opportunity;
loss of goodwill;
loss arising from delays beyond its reasonable control.

19.4. Mandatory consumer rights remain unaffected.

20. COMPLAINTS

20.1. Complaints may be submitted to:

20.2. Timeless Watches Kft. shall investigate complaints in a commercially reasonable manner.

20.3. Customers are encouraged to provide all information reasonably necessary to facilitate investigation of a complaint.

21. GOVERNING LAW AND JURISDICTION

21.1. These Terms shall be governed by the laws of Hungary.

21.2. For Business Customers, the competent courts of Budapest, Hungary shall have exclusive jurisdiction over disputes arising from these Terms or any Contract.

21.3. Consumers retain any mandatory rights relating to jurisdiction and consumer protection provided under applicable law.

22. ENTIRE AGREEMENT

22.1. These Terms, together with the incorporated policies, constitute the entire agreement between the parties regarding purchases made through the Website.

22.2. Product descriptions, photographs, invoices, order confirmations and written communications relating to a specific Product form part of the Contract.

22.3. General advertising, promotional materials and marketing statements do not create additional warranties or contractual obligations unless expressly incorporated into the Contract.

22.4. Failure by Timeless Watches Kft. to enforce any provision shall not constitute a waiver of rights.

23. FINAL PROVISIONS

23.1. If any provision of these Terms is determined to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

23.2. Timeless Watches Kft. reserves the right to amend these Terms from time to time.

23.3. The latest version shall be published on the Website.

23.4. These Terms shall be interpreted together with:

23.5. In the event of any discrepancy between language versions, the Hungarian version shall prevail.
